Summary Judgment Obtained On Behalf Of ED Physician and PA

Summary

Senior Associate Bruce E. Wingate secured summary judgment on behalf of their clients, an emergency room doctor, and a physician assistant for alleged failure to diagnose and treat central retinal artery occlusion (CRAO) leading to permanent neurological and visual damage.

Our motion practice to secure summary judgment required the opinions of specialists in emergency medicine and ophthalmology, and plaintiff opposed in opposition to the relief sought.

Justice Pineda-Kirwan in Supreme Court Nassau County found that plaintiff’s expert opinion failed to raise a triable issue of fact and granted our motion for summary judgment in its entirety.
