Defense Verdict On Behalf Of Cardiothoracic Surgeon

Defense

Congratulations to Partner, Elizabeth Horan. Ms. Horan and the McHenry & Horan team received a defense verdict in Supreme Court, Suffolk County on behalf of a cardiothoracic surgeon.

Following a diagnoses of Stage 3 adenocarcinoma of the esophagus and subsequent courses of chemotherapy and radiation, the plaintiff in this case presented to our defendant surgeon who took part in the performance of a minimally invasive Ivor Lewis esophagectomy. Over the course of his post-operative period, the plaintiff developed a leak at a surgical connection made during the esophagectomy. Plaintiff alleged that our surgeon and the other defendants were negligent in failing to timely diagnose and treat the leak, leading to permanent injury.

Over the course of nearly three weeks, the jury was carefully guided through the intricacies of plaintiff’s complex Ivor Lewis esophagectomy and its attending risks. Following a hard-fought case, the jury ultimately returned a verdict supporting the surgeon that Ms. Horan was defending.

We at McHenry & Horan are proud to have the privilege of defending individuals who have dedicated their lives to improving the health of others. We see success at trial as confirming the experience and skills that form the bedrock of our firm.
